This article is about public ownership of creative works.

For use in relationship to public lands, see public domain (land).

Public domain comprises the body of knowledge and innovation

(especially creative works such as writing, art, music, and inventions)

in relation to which no person or other legal entity can establish or maintain

 proprietary interests within a particular legal jurisdiction. This body of information

 and creativity is considered to be part of a common cultural and intellectual

 heritage, which, in general, anyone may use or exploit, whether for

commercial or non-commercial purposes. Only about 15 percent of

all books are in the public domain, and 10 percent of all books are still in print.

If an item ("work") is not in the public domain,

 this may be the result of a proprietary interest such as a copyright,

patent, or other sui generis right. The extent to which members of the

public may use or exploit the work is limited to the extent of the

 proprietary interests in the relevant legal jurisdiction.

 However, when the copyright, patent or other proprietary

 restrictions expire, the work enters the public domain

and may be used by anyone for any purpose.

Sec. 107. - Limitations on exclusive rights: Fair use

Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include -

(1)

the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

(2)

the nature of the copyrighted work;

(3)

the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

(4)

the effect of the use upon the potential market for or value of the copyrighted work.

The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors
